A young woman convinced a young man that he could earn substantial profits in a short period through investing in gold. Based on this, he transferred AED 75,000 to her bank account and awaited the returns, only to discover that the money had been lost. The Al Ain Court for Civil, Commercial, and Administrative Cases ruled that the defendant must return the amount and pay AED 2,000 as compensation to the plaintiff for the damages he suffered.
In detail, the young man filed a lawsuit against the woman, demanding that she return AED 75,000 and compensate him with AED 5,000 for the psychological and material harm she caused, in addition to fees and expenses. He based his claim on the fact that she received the money under circumstances that suggested the illegitimacy of its source. He had transferred the amount to her via bank transfer for gold investment, with the understanding that she would return the amount along with profits. However, she neither returned the principal nor the agreed-upon profits, and he emphasized her criminal liability.
The court stated in its ruling that, according to the provisions of the Civil Transactions Law, “No one is permitted to take another person’s money without a legitimate reason, and if they do, they must return it.” The court noted that the defendant appeared at the final hearing but provided no evidence to prove her innocence. The court concluded that the defendant’s financial obligation regarding the claimed amount was due to the plaintiff.
Regarding the compensation claim, the court noted that the defendant’s fault was established, resulting in material and moral harm, as the plaintiff was deprived of benefiting from the misappropriated amount due to the defendant’s actions. The court added: “With the causal link between the fault and the damage established, the defendant is legally obligated to compensate.”
The court ruled that the defendant must pay the plaintiff AED 77,000, as detailed in the judgment, in addition to fees and expenses.
